बार कौंसिल ऑफ़ राजस्थान के पच्चीस सदसयो की निर्वाचन प्रक्रिया को लेकर
सुनवाई कर रहे ,बार कौंसिल ऑफ़ इण्डिया के निर्वाचन ट्रिब्यूनल क्रम तीन ने
प्रस्तुत सभी याचिकाओं में वर्णित तथ्यों को प्रोसीरजरल अनियमित्ता मानते
हुए इस आधार पर निर्वाचन प्रक्रिया को रद्द करने से इंकार करते हुए दस दिन
के भीतर भीतर निर्वाचित सदस्यों की अधिसूचना जारी करने के निर्देश दिए है
,उक्त आदेश के बाद बार कौंसिल ऑफ़ राजस्थान के गठन को लेकर असमंजस की स्थिति
खत्म हो गयी है ,जबकि बार कौंसिल ऑफ़ राजस्थान के चेयरमेन पद ,उपाध्यक्ष
,बार कौंसिल ऑफ़ इण्डिया प्रक्रिया मामले में सामंजस्य बैठाने और अपने पक्ष
के व्यक्ति को चेयरमेन बनाने की भागदौड़ तेज़ हो गयी है ,प्रक्रिया में रंजीत
जोशी की प्रबल दावेदारी है ,बार कौंसिल ऑफ़ राजस्थान नियमावली के तहत हर
साल एक चेयरमेन ,एक वाइस चेयरमेन ,एक बार कौंसिल ऑफ़ इण्डिया के सदस्य का
निर्वाचन होता है ,,और इस तरह से पच्चीस सदस्यों में से बारह सदस्य एडजस्ट
होने से इनका गठबंधन भी हो सकता है ,जबकि अनुशासन समितियों में दो सदस्यों
के अलावा एक सदस्य जो निर्वाचित नहीं है उसे भी बनाया जाता है इसके लिए भी
लामबन्दी शुरू हो गयी है ,,इलेक्शन ट्रिब्यूनल ने BCI: D: 2746/2018

Mr. Justice D. N. Thanvi, the Hon’ble Observer was appointed only eleven days prior to the polling and it was impossible for him to keep control over so many booths spreading all over the State of Rajasthan. Hon’ble Justice Mr. D. N. Thanvi, even did not call for any meeting of all the Assisting Returning Officers for ensure free and fair election, CCTV coverage, videography was not available in many of the polling booths indicating in rampant corruption. Mr. Bhatacharya, learned advocate refers to the decision in the case of Abhiram Singh Vs. C. D. Commachen (Dead) by Legal Representatives reported in (2017) 2 Supreme Court Cases 629 to highlight his submissions with such religion, casts and community casts should not have been played by the candidates. He draws our attention to the observations of the Supreme Court of India that for such negative appeal of a single instance of such nature has been enough to vitiate the election of the candidate.
We are of the opinion that all the allegations are of procedural irregularities, but there is no proof of tempering of votes. If in one polling booth voters cast their votes in favour of one candidate, this tribunal is undone.
We are not inclined, therefore, to set-aside the entire election of Bar Council of Rajasthan because of such procedural irregularities as we are bound by the order of the Supreme Court of India dated May 2, 2018 in T.C.C. No. 126 of 2018, holding, inter-alia, that the entire election could not be set-aside on the basis of procedural irregularities only .
All the petitions are therefore rejected. There is a report of the Hon’ble observer. The Hon’ble Observer reports that the entire election was conducted in proper manner. We accept his report and direct the Secretary, Bar Council of Rajasthan to take appropriate steps for gazette publication of the result as early as possible preferably not late than ten days. इस तरह से अब अगर कोई सुप्रीम कोर्ट से विपरीत आदेश नहीं लाता है तो राजस्थान में बार कौंसिल ऑफ़ राजस्थान के गठन एक सप्ताह में किया जाकर ,निर्वाचित लोगो को कार्यभार सुपुर्द कर दिया जाएगा ,,अख्तर खान अकेला कोटा राजस्थान
